New York State Marriage License

Where to Obtain:

  • A couple intending to marry in New York State must apply in person for a marriage license at any town or city clerk in the state.
  • The Chili Town Clerk’s Office is located at 3333 Chili Ave.  Appointments are required.  Please call 585-889-6127 to schedule an appointment. It generally takes about 15 minutes to obtain your license. Both parties must be present. Blood tests are no longer required.
  • The application for a license must be signed by both parties in the presence of the town or city clerk.
  • A representative cannot apply for the license on behalf of the couple.  This applies even if the representative has been given the Power of Authority.

Documents Required to Obtain License

A person is required to establish proof of age and identity by submitting to the issuing clerk:

One of the following original with raised seal age-related documents that shows birth name, birth location, birth date and parents names:

  • Birth Certificate
  • Baptismal record
  • Naturalization record
  • Census record

And one of the following identity-related documents:

  • Driver’s license
  • Passport
  • Employment picture ID
  • Immigration record

If previously married, a certified copy of the Decree of Divorce or a Certificate of Dissolution of Marriage is required for each and every divorce, including judgments of divorce.

If a spouse is deceased, a copy of the death certificate is required.

The marriage license is valid 24 hours after it is issued and is only valid for sixty (60) days.

Cost to Obtain

The fee for the license is $40.00. We accept cash, check, Visa, Master Card and Discover.

The fee includes the issuance of a Certificate of Marriage which is sent to the applicant within 15 days after the license is returned by the officiant (person who performs the ceremony).

Where to Obtain Copies of Marriage Records

Marriage records are kept in the office that issued the original license. If you obtained your license at the Chili Town Clerk’s Office and require a Certified Transcript of Marriage you may do so by remitting a notarized written request or stopping in to the Town Clerks Office.

The fee for a Certified Transcript of Marriage Certificate is $10.00.

New York State Passes Law to Allow for One Day Marriage Officiants

Commencing March 28, 2023, a change was made in the NYS Domestic Relations Law that provides for designation of a one-day marriage officiant. This is in response to an increased desire of couples wishing to have friends or family perform their marriage ceremony.

The application for a one-day officiant license will capture the name, date of birth, address, email address and telephone number of the applicant as well as the names, dates of birth and addresses of the parties to be married as they appear on the application for a marriage license. The One-Day Marriage Officiant should schedule their appointment to occur simultaneously or after the couple has obtained their marriage license. The marriage officiant must apply for the one-day license from the same office that is issuing /issued the couple’s marriage license as information must match on both applications.  The issuing clerk is to collect a $25.00 fee for this application. If the applicant cannot appear in person, they should fill out the application, have it notarized, and mailed to the Town Clerk with the $25 fee in sufficient time to process the application prior to the wedding.
